Imputation of Income
Imputation of income deals with child support inequities that arise when one
spouse attempts to avoid responsibility for child support by not working, or
earning less than they should be or could be earning. This method determines
child support based upon reasonable potential income at full employment, rather
than current underemployed or nonworking income.
If your spouse is unemployed or underemployed, you may be eligible to seek child
support based on the additional income they could or should be reasonably
receiving. In complex and high-income cases, we may call upon a vocational
counselor to evaluate your spouse's skills and experience in order to determine
their true earning potential.
Imputation of income is a powerful tool for getting children the financial

Holidays & Custody
We know holidays can be a difficult time for children in separated or
divorced families, not to mention the emotional toll you suffer as well.
Both the law and loving parents apply the same standard, what is in "the
best interest of the child."
You may be required to reschedule or rework what were once long-time traditions.
For example, one parent often has the child on Christmas Eve until the afternoon
of Christmas Day, with the schedule switching for the following year.
Parents may divide the holidays by 1/2 days or by every other Holiday. The
manner in which holidays are divided should be spelled out clearly in your
Custody or Marital Settlement Agreement.
Parents often believe they will be able to work out a holiday schedule when the
time comes and fail to provide up front guidance for sharing the holidays in
these most important agreements.
Of course, the divorcing parties can always make spur-of-the-moment changes for
any given holiday, as long as they both agree. However, when an agreement
cannot be reached, there is far less anxiety and struggle when you know the
matter has been legally settled beforehand. And of course, children most often
feel most comfortable in a stable and known situation, especially where their
favorite holidays are concerned.
